1. About Us
Beyond Byron Experiences Pty Ltd (ACN 637 514 115) trading as Beyond Byron E‑Bikes (BBEB, we, us) provides electric bicycle hire and self‑guided recreational riding services only.
BBEB does not provide guided tours, supervision, instruction, or on‑route support.
2. Bookings and Contract Formation
2.1 By making a booking through our website or booking platform, you agree to these Website Terms & Conditions.
2.2 All riders are required to electronically accept BBEB’s Bike Hire & Self‑Guided Ride Agreement and Waiver prior to riding. The waiver forms part of the contract between BBEB and each rider.
2.3 If there is any inconsistency between these Website Terms & Conditions and the waiver, the waiver prevails to the extent permitted by law.
3. Eligibility and Rider Requirements
3.1 Bike hire is available to riders aged 18 years and over, or minors riding with a parent or legal guardian who accepts responsibility on their behalf.
3.2 Riders must be physically fit, competent, and capable of riding an electric bicycle.
3.3 Riders must not ride under the influence of alcohol or non‑prescribed drugs.
4. Self‑Guided Riding
4.1 All rides are self‑guided. Riders are responsible for their own navigation, route selection, speed, decisions, and safety at all times.
4.2 Any maps, route suggestions, or information provided by BBEB (including via smartphone or digital platforms) are provided for general information only and do not constitute guidance or advice.
5. Helmets, Safety, and Road Rules
5.1 Approved bicycle helmets are mandatory and must be worn at all times while riding.
5.2 Riders must comply with all applicable road rules, traffic laws, and regulations.
5.3 Riders must wear appropriate footwear and use the bike responsibly and within their abilities.
6. Bike Sizes
6.1 Riders are responsible for selecting the correct bike size based on the sizing information provided on our website.
6.2 If an incorrect size is booked and a suitable alternative is not available, BBEB may issue a credit for future use at its discretion.
7. Hire Period and Late Returns
7.1 Bikes must be returned to the agreed return location by the agreed return time.
7.2 Late returns may incur a late return fee of $1 per minute per bike (or such other rate disclosed at booking).
8. Damage, Loss, and Theft
8.1 The rider is responsible for the care, custody, and control of the bike and any hired equipment during the hire period.
8.2 Riders are liable for the reasonable cost of repair or replacement for any damage beyond fair wear and tear.
8.3 Riders are liable for the reasonable replacement cost of any bike or equipment that is lost or stolen during the hire period.
8.4 BBEB may charge the rider’s nominated payment method or issue an invoice for amounts payable under this clause.
9. Cancellations and Changes
9.1 If a rider fails to arrive within 30 minutes of the agreed start time, and has not contacted BBEB to advise of a delay, BBEB may treat the booking as a no‑show, cancel the booking, and retain payments made.
9.2 Cancellations made up to 11:59pm on the day before the booking date are eligible for: - Rescheduling to another date or time (subject to availability); or - A gift card or credit for future use.
9.3 Cancellations made on the day of the booking, or failure to attend, are not refundable and are not eligible for credit.
9.4 BBEB may cancel or vary a booking due to weather, safety concerns, or events beyond our control. If BBEB cancels a booking, a reschedule, credit, or refund will be provided at BBEB’s discretion.
10. Wildlife and Environment
10.1 Riders may encounter wildlife during self‑guided rides.
10.2 Riders must not approach, interact with, or disturb wildlife.
10.3 Riders are encouraged to follow Leave No Trace principles.
11. Rescue and Recovery
11.1 If a rider is unable to complete their ride and requires collection, a recovery fee may apply as disclosed at booking.
12. Australian Consumer Law
12.1 Nothing in these Website Terms & Conditions excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.
13. Privacy
13.1 By making a booking, you consent to BBEB collecting, using, and disclosing personal information in accordance with our Privacy Policy.
14. Governing Law
14.1 These Website Terms & Conditions are governed by the laws of New South Wales, and the parties submit to the exclusive jurisdiction of NSW courts.
